Emergency notice: NiVyn ElderSafe is not 911, an emergency dispatch centre, a medical device or a guarantee that another person will respond. For an emergency, contact local emergency services directly.

Eligibility and consent

You must be at least 18 to create an account. You may not use NiVyn ElderSafe to monitor an adult without their informed consent or other lawful authority. Location sharing is controlled by the person whose location is being shared.

The service

NiVyn ElderSafe provides family check-ins, communication, safety notifications, privacy-first location sharing when enabled, saved-place alerts, expected-arrival plans, coordination tools and related subscription features. Feature availability can depend on permissions, device operating systems, network connectivity, subscription plan and third-party providers.

Your responsibilities

• Keep account credentials and devices secure.
• Use accurate information and maintain correct family contact details.
• Do not bypass consent, security, rate limits or access controls.
• Do not use the service for stalking, harassment, covert surveillance or unlawful monitoring.
• Do not rely on NiVyn ElderSafe as the sole means of protecting a person from imminent harm.

Subscriptions and billing

Paid features may be offered monthly or annually. Current prices and plan features are shown before purchase. Store purchases are also subject to the applicable Apple or Google billing rules. Website billing may be processed by Stripe. Cancellation stops future renewal according to the applicable purchase channel.

Location and safety features

Location accuracy and background delivery depend on device hardware, permissions, battery state, operating-system restrictions and network availability. Arrival/departure, driving, crash or fall related signals can be delayed or inaccurate. NiVyn ElderSafe labels unvalidated crash/fall events as suspected and does not represent them as medical-grade detection.

Availability

We work to provide reliable service, but internet, carrier, push, cloud and device failures can delay or prevent check-ins and notifications. Test your configured family alert paths and maintain another way to contact the people you care about.

Privacy

Use of NiVyn ElderSafe is also governed by the Privacy Policy. You can request access, export, correction or deletion through the application and privacy channels.

Suspension and termination

Accounts may be suspended for abuse, security threats, fraud, unlawful monitoring or serious violations of these terms. You may request account deletion at any time, subject to records that must legally be retained.

Governing law

For users in Quebec, mandatory rights under Quebec and Canadian law continue to apply and are not waived by these terms.
